INDUSTRIAS MEMPER S.A. de C.V. Privacy Notice for Customers
In compliance with the Federal Law on Protection of Personal Data Held by Private Parties, we hereby provide you with this Privacy Notice. We appreciate your careful reading of this Privacy Notice, which mentions the use, treatment, terms and procedures to be followed in case you consider limiting the use of the Personal Data that you decide to provide to us.
1. Responsible for the protection of your Personal Data.INDUSTRIAS MEMPER S.A. de C.V., with the commercial name INDUSTRIAS MEMPER (hereinafter referred to as “the Company”), with address at Rio Lerma 169, Fraccionamiento Industrial Tlalnepantla, Tlalnepantla de Baz, 54030, State of Mexico, Mexico; is responsible for collecting your personal data as well as for its treatment and protection.
2. Personal Data collected for its treatment and means of obtaining it.
The personal data that we collect from you, including images and sounds captured by security cameras, for the purposes described in section four (4) of this privacy notice, are collected in person, by phone, when you provide us with your data through the website, social networks (name and email), emails, expos, video surveillance cameras as well as in our office in person, which will be safeguarded physically and electronically in our office in a database under the strictest confidentiality.

The Asset Data that we collect from you in person are for bank operations and invoicing:
- Bank Account Number.
- Bank CLABE.
- Name of the Account Holder.
- Financial Institution.
- Data for Invoicing.
- Credit Application.
The personal data you provide us will be treated in accordance with the principles of legality, loyalty, proportionality, quality and only for the purposes described in this privacy notice. Likewise, for the protection of your personal data, we will establish the administrative, technical and physical security measures that allow us to protect your personal data against damage, loss, alteration, destruction or use other than that indicated in this privacy notice.
2.1. Data of persons in a state of incapacity.
We inform you that it is of our special interest to protect the personal information of Persons in a state of interdiction and different capacities in terms of the law; the data that will be treated and protected under the highest security and confidentiality measures.

We do not collect sensitive personal data.
4. Purposes of the personal data collected.
Your personal data are collected for the following primary purposes:
To satisfy the needs of our customers who require high quality nodular iron castings, through the use of consolidated systems of people and resources to achieve sustainable and competitive development.
Production, casting, manufacturing, fabrication, packaging, repair, marketing, distribution, import and export of any type of parts, spare parts, accessories, tools-machinery, products or raw materials for the industry in general.
Sale of products for the automotive industry both domestic and foreign. Our company imports materials for the manufacture of our products and at the same time exports our merchandise.
5. Refusal to the treatment of your Personal Data for Secondary Purposes.
Secondary purposes not necessary for the legal relationship with the responsible party:
Information about new products and services through phone calls.
Specific campaigns.
The refusal to use your Personal Data for secondary purposes will not be, at any time, exclusive to provide the requested service.

6. Transfer of Personal Data.
For the provision of goods and services contracted with INDUSTRIAS MEMPER, your personal data may be transferred to third parties with whom there is some type of legal or business relationship, in order to provide the services contracted for the purposes related to section (4) of this Privacy Notice.

7. Means and Procedure for the exercise of ARCO Rights.
To exercise your ARCO rights (Access, Rectification, Cancellation and Opposition) you must send a written request to the attention of the Personal Data Department via email to the address privacidad@memper.com.mx and/or deliver it physically to the address free of charge, which must contain the following requirements:
- Full name of the owner.
- Address or other means to communicate the response. If this requirement is not met, the request will be considered not submitted.
- Documents proving your identity (IFE, passport, military service card, professional ID). In case of acting through a legal representative, it will be necessary to prove the personality through a granted power of attorney and identification.
- A clear and precise description of the personal data in respect of which you seek to exercise the ARCO Rights.
- Any other element or documentation that facilitates the location of personal data.
- Once your request is received, we will have 20 business days from the date of receipt to notify you of the decision taken, which, if applicable, will be effective within 15 business days following the date on which the response was communicated.
- We inform you that if the request is insufficient or erroneous, the period indicated in the previous paragraph will be counted as a period of five business days from the date of receipt of the request. To inform you of the requirement to complete or rectify the error, you will have a period of 10 business days to meet said requirement, which, if met, will continue the process; otherwise, the request will be considered not submitted.
- In the case of requests for Access to your personal data, they will be delivered physically by means of simple copies and free of charge, you will only have to cover the shipping costs or the reproduction costs for issuing simple copies or electronic documents, upon prior accreditation of the owner or legal representative.
8. Mechanisms and Procedure to revoke your consent.
At any time you may revoke your consent to the processing of your personal data. To do so, you must send us an email written in Spanish to the following address privacidad@memper.com.mx, which must contain the requirements indicated in section seven of this privacy notice, specifying the personal data to which you decide to revoke said consent.
Within a period of no more than 20 business days from receipt of your email, we will revoke the requested data.
It is important to bear in mind that we will not be able to fulfill your request or immediately cease use in all cases, since it is possible that due to some legal obligation we may require to continue processing your personal data. Likewise, you should consider that for certain purposes, the revocation of your consent will imply that we cannot continue to provide you with the service you requested, or the termination of your relationship with us.
9. Options available to the owner to limit the use or disclosure of their Personal Data.
At any time, you may limit your consent to the use and disclosure of your personal data through mechanisms other than the exercise of ARCO rights, consisting of sending an email to privacidad@memper.com.mx or a written notification addressed to the Data Protection Department, indicating which data you want to limit its use.
10. Use of cookies, web beacons or other similar technologies.
Cookies are texts that are automatically downloaded and stored on the hard drive of the user’s computer equipment when browsing a specific internet page, which allows the internet or email server to remember, which can be used to monitor the behavior of a visitor, such as storing information about the user’s IP address, duration of time of interaction on said page and the type of browser used, among others.
We inform you that through obtaining personal data through our website, we DO NOT collect any information from cookies, web beacons or other similar technologies.
11. Procedures and means for changes to the Privacy Notice.
We reserve the right to make modifications or updates to this privacy notice at any time, in accordance with new legislation, internal policies or new requirements for the provision of our services or products.
These modifications will be available to the public through the following means:

- B) Notices visible in our office.
12. Improper Treatment of Your Personal Data.
If you consider that your right to the protection of your personal data has been violated by any conduct of our employees in these actions or responses, you presume that there is a violation of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties in the treatment of your personal data, you may file the corresponding complaint or complaint with the INAI on the page http://www.inai.org.mx
